These terms and conditions apply to all workshop bookings and participatory engagements made with NOCTURN Creative Limited ("we", "us", "our"). By completing a booking, you confirm that you have read and agree to these terms.

Please note: These terms relate solely to NOCTURN's community dance and arts activity. Web design services are provided under a separate contract through NOCTURN Designs (nocturndesigns.com) and are not covered here.

1. About Us

2. Bookings

All workshop bookings are made through our website using the Squarespace booking and payment platform. A booking is confirmed once payment has been received in full (or the first instalment, where a payment plan applies — see Section 4).

We reserve the right to decline or cancel a booking at our discretion, in which case a full refund will be issued.

Confirmation of your booking will be sent to the email address you provide at checkout. Please check your spam folder if you do not receive this within 24 hours of payment.

3. Pricing & Payment

Workshop prices are as listed on our website at the time of booking. Payment is processed securely via Stripe. We accept major debit and credit cards.

Some workshops are provided free of charge as part of funded community engagement projects. Where this is the case, it will be clearly stated on the booking page.

We do not generally offer concession rates. Any exceptions will be clearly communicated on the relevant workshop page.

4. Payment Plans

For certain workshops, we may offer the option to spread the cost across a set number of monthly instalments. Where this option is available, it will be shown at the point of booking.

By entering into a payment plan, you agree to pay all instalments by the dates specified. If a payment fails or is not received, we reserve the right to cancel your place and apply our standard cancellation terms.

5. Cancellations & Refunds

Cancellation by you

If you need to cancel your place, please notify us as soon as possible at hello@nocturncreative.co.uk.

  • More than 7 days before the workshop: We will offer a full refund or, if you prefer, carry your payment over to a future workshop.

  • 7 days or fewer before the workshop: We are unable to offer a refund. In some circumstances, at our discretion, we may offer to carry your payment over to a future workshop of equivalent value. This is not guaranteed and will be considered on a case-by-case basis.

Cancellation or rescheduling by us

In the event that we need to cancel a workshop — due to unforeseen circumstances, insufficient bookings, venue issues, or artist illness — we will notify you as soon as possible and offer you a rescheduled date. Where a rescheduled date is not possible or is not suitable for you, a full refund will be issued.

We are not liable for any travel, accommodation, or other costs you may incur as a result of a cancellation or rescheduling.

6. Eligibility

Unless otherwise stated, our workshops are open to participants aged 18 and over.

Some projects or workshops may have specific eligibility criteria (for example, a focus on participants aged 50 and over). Any such requirements will be clearly stated on the relevant booking page. By booking, you confirm that you meet the stated eligibility for that workshop.

7. Health Declaration

Participation in our workshops involves physical movement activity. As part of the booking process, you will be required to complete a health declaration form at checkout confirming that you are aware of your own physical condition and any relevant health considerations. Your booking will not be confirmed until this form is completed.

It is your responsibility to inform us of any health conditions, injuries, disabilities, or other factors that may affect your safe participation. This information will be treated confidentially and used only to support your safety during sessions.

If your health circumstances change between completing the declaration and attending a session, please let us know before the session begins.

We are not medical professionals and cannot provide medical advice. If you are in any doubt about whether a workshop is suitable for you, please consult your GP before booking.

8. Participation & Conduct

We are committed to creating a safe, inclusive, and respectful environment for all participants. We ask everyone to:

  • Treat fellow participants, artists, and venue staff with respect

  • Follow any guidance given by workshop leaders regarding movement or safety

  • Inform us of any accessibility requirements in advance so we can make reasonable adjustments

We reserve the right to ask any participant to leave a session if their behaviour is deemed unsafe, disruptive, or incompatible with the values of our work. In such cases, no refund will be issued.

9. Venues

Workshops take place at venues booked by NOCTURN Creative Limited. Venue details will be confirmed in your booking confirmation. Participants are responsible for making their own way to and from the venue.

Please note that venue-specific rules and procedures (including fire evacuation procedures) apply and must be followed.

10. Photography & Filming

We may photograph or film workshop sessions for documentation, promotional, and archival purposes. Consent will be sought verbally at the start of each session. If you do not wish to be photographed or filmed, please inform the workshop leader at that point and we will do our best to accommodate your preference.

Where images or footage are used in public-facing materials, we will not identify participants by name without their explicit permission.

11. Insurance & Liability

NOCTURN Creative Limited holds appropriate public liability insurance through People Dancing (the Foundation for Community Dance).

Whilst every care is taken to ensure sessions are delivered safely, participants take part at their own risk. We are not liable for any personal injury, loss, or damage to personal property sustained during a workshop, except where this results from our own negligence.

We strongly recommend that participants with valuable items leave them securely at home where possible, as we cannot take responsibility for personal belongings at venues.

12. Data & Privacy

Any personal data collected as part of your booking — including health declarations — is processed in accordance with our Privacy & Cookie Policy, available on our website.

We will use your contact details to communicate with you about your booking and, if you consent, to send you updates about our future work.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these terms from time to time. The current version will always be published on our website. Your booking is governed by the terms in place at the time of that booking.
